DMCA Policy

1. Overview

ClareNow respects the intellectual property rights of content creators and publishers. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA") and applicable international copyright law, we respond promptly to notices of alleged infringement.

ClareNow is a news aggregation platform. We link to original articles at their source and display AI-generated summaries intended to inform readers — not reproduce full article text. If you believe our use exceeds fair use or violates your copyright, please follow the process below.

2. Submitting a Takedown Notice

If you are a copyright owner (or authorised to act on behalf of one) and believe that content on ClareNow infringes your copyright, please send a written DMCA Takedown Notice to us at info@clarenow.com containing the following:

  1. Identification of the copyrighted work — A description of the work claimed to be infringed. If multiple works are involved, a representative list is acceptable.
  2. Identification of the infringing material — A description of the material you claim is infringing and its specific URL(s) on our platform.
  3. Your contact information — Your name, address, telephone number, and email address.
  4. Good faith statement — A statement that you have a good faith belief that the use of the material is not authorised by the copyright owner, its agent, or the law.
  5. Accuracy statement — A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorised to act on their behalf.
  6. Signature — Your physical or electronic signature.

We aim to respond to all valid DMCA notices within 48 hours.

3. Counter-Notice Procedure

If you believe content was removed as a result of a mistake or misidentification, you may submit a Counter-Notice to info@clarenow.com containing:

  1. Your physical or electronic signature.
  2. Identification of the material removed and where it appeared before removal.
  3. A statement under penalty of perjury that you have a good faith belief the material was removed due to mistake or misidentification.
  4. Your name, address, telephone number, and email address.
  5. A statement consenting to jurisdiction of the federal district court in your judicial district (or any judicial district in which ClareNow may be found if outside the US), and that you will accept service of process from the original complainant or their agent.

Upon receipt of a valid Counter-Notice, we will forward it to the original complainant. If no court action is filed within 10–14 business days, the removed content may be restored.

4. Repeat Infringers

ClareNow maintains a policy of terminating, in appropriate circumstances, accounts of users who are repeat infringers of intellectual property rights, in accordance with the DMCA.

5. Misuse of the DMCA Process

Submitting a false or misleading DMCA notice or Counter-Notice may result in legal liability including damages, costs, and attorneys' fees under 17 U.S.C. § 512(f). We reserve the right to seek damages in such circumstances.

6. Fair Use & News Aggregation

ClareNow operates under the principles of fair use by providing transformative, AI-generated summaries, linking back to original sources, and not reproducing full articles. Our summaries are intended to direct traffic to original publishers — not replace them. We take all legitimate copyright concerns seriously and will act promptly upon receipt of a valid notice.
